Buy and Bust
A buy and bust case involves an undercover officer purchasing drugs from a seller
and then notifying a nearby backup team with a description of the seller. The
seller is then apprehended and held for confirmatory identification by the undercover
officer. Upon arrest, the seller may be found to possess additional drugs or
so-called "buy money", that is, the money the undercover used in the
purchase which was previously photocopied for identification.
Observation Sale
An observation sale is when an officer personally observes a drug transaction
but does not participate in it. The observing officer will notify a team of officers
with descriptions of the seller and the buyers who are then apprehended.
Automobile Presumption
A controlled substance in an automobile is presumed to be possessed by each and
every person in the automobile at the time the controlled substance was found,
unless the controlled substance was concealed on the person of one of the occupants.
Room Presumption
A controlled substance or marijuana in open view in a room, under circumstances
evincing an intent to mix or package it, is presumed to be possessed by each
and every person in close proximity to it at the time the substance was found,
unless the substance was concealed on the person of one of the occupants.
